i recently downloaded a movie called the haunting in conneticut and yesterday i was sent an email from bayTSP via my isp, for those who do not know bayTSP is a copyright infringement company. i downloaded the torrent from the pirate bay, i suggest not downloading from them again and no this is not another one of them scams saying stop torrenting coz it's bad just torrent from somewhere else. a great program to use is "bit che" just google it, it searches like 30 different torrent sites for the torrent u want but dont download off of sumotorrent or torrentportal coz the files may aswell be called didyouaskforencodedporn?wellyougotitlol.f***you... if someone else has had this email sent to them please get back to me. |

how do people even get on private trackers? i would say that you would have to be invited by an existing member who has an invitation to offer you. i'd dare say that you would have to keep your share ratio up so strangers would be relunctant to give you an invite. if your account is dogs balls then they can suffer for inviting you in the 1st place. and friends would be reluctant because they know what a leeching snatcher you are. best bet, 'take your ass down to blockbuster, and hire your ass a video' !!!!! |

Peerguardian does protect your IP from torrent applications attempting to connect to your computer from other users - but it doesn't protect your IP from the tracker. By definition of the torrent protocol you have to connect to a tracker to find other users, then connect to those users to download the file parts. Anti-piracy companies are monitoring the public trackers. If your computer requests tracking information for the file 'Terminator Salvation.avi' for example, the anti-piracy interests will send your ISP a copyright infringement notice. What is not clear to me is how far the anti-piracy companies go to ensure that the requested file is actually copyrighted material (just because it's called xxxx.avi doesn't mean that it is xxxx). Also, is a connection to a tracker enough to prosecute? Then there's the issue of sharing (distribution). Your IP is listed on the tracker as a source for a file - but it doesn't mean that anyone can connect to your computer to get that file. You could have a firewall blocking all incoming ports, for example. So there is a ridiculous amount of untested grey area, legally speaking. I think it's going to be the big 'iiNet' type court cases that will determine the future of torrents. It's unfortunate if piracy kills the torrent protocol because I think it's a great decentralised downloading system that can only help to spread out the internet from key nodes and increase the speed and reliability in general. I would like to see more sites embracing torrent downloads as preferable to downloading from their webserver. |

I thought it was generally the sharing of the data and the distribution angle that they busted people for, not so much the downloading but the fact you're uploading to other people at the same time and hence distributing it yourself. Thats where stuff like Peerguardian comes in, because it blocks the dodgy IP addresses and won't download data from them or upload data to them. Sure they could query a tracker and get your IP address, but without any proof that you're actually uploading or downloading anything I'd imagine they would have a hard time making a case.

He's going to the pub afterwards with the prosecutor, not with you. Fail at understanding of legal proceedings. The Judge would give a lengthy talk to the jury (public representation) about the law involved and the issues with finding the defendant guilty or not guilty. A case like this would be used to test one or more specific aspects of copyright law in order to set a precedent for future cases. Contrary to your statement, such a case would be very very precise and technical. |

I only have a couple of torrent sites that i use and have been using for years. If you're scared about the whole public torrent sites then i suggest that you sign up for ones that offer invitational only memberships. Although you'll have to remember that upload/download ratios will come into account.

I gave a lengthy testimony and nothing the prosecution said made sense - I pointed out the wrongness of everything they said. The judge gives no talk - the judge hardly talks at all. All I heard him say was "I don't see how the police could be wrong" or something like that. I didn't even hear if I was guilty/not guilty at the end - couldn't actually hear what the judge had said. Took me 2 weeks to find out when they sent me a letter saying to pay a fine. The judge and prosecutor were co-workers, in the same building, I don't see how this could ever go fairly.
So contrary to your statements - you're both naiive and don't understand the purpose of the courts or how society works. Well... Mr Hardware. Once again. I mean currently they are safer because there isn't as much interest in them from the MPAA and such however unlike a group like TPB who never actually have any of the offending material on their servers newsgroups host the files themselves. I'm fairly certain the combined value of the contents of every qgl (ausgamers?) poster's hard drive would exceed the gross world product by a fair amount.
As a consumer this is brilliant, any content I want for the cost of a standard broadband connection. From a business perspective it's pretty astounding that such rampant piracy and blatant, publicly flaunted breaches of copyright and IP has been allowed to flourish and indeed become a profitable business for a lot of people. There's definitely going to be a lot of movement on this in the coming years. On a side note, you're stupid for using public torrents for your day to day stuff. Sites like demonoid are not private. Applications like peer guardian do not protect you from anything, you're still reporting to the tracker that you have x amount of y file, they only need to query the trackers. |

Newsgroups are considered safer than public trackers because you use encrypted connection to connect to the news server, the news server company claims it logs no more than is required to bill you or protect itself from you spamming, and they believe they are protected by common carrier protections like telephone companies and the postal service
news server companies have handed over user records to the US law enforcement in the past to do with child pornography, worms and valve. These known events involve the uploader to news servers, not downloaders. I've never heard of a newsgroup downloader getting a c&d letter. |

Well, contrary to your contrariness I actually do have experience in court cases relating to engineering and traffic offenses. I have also had experience with Jury Service in County Court, although I didn't make the final Jury selection I heard that case and experienced quite a bit of the legal proceedings of what was a complex case.
